Terms of Service

These terms are the agreement between you and us when you use PulseKeeper. They are written to be read. If something is unclear, ask us.
1. The service
PulseKeeper ("the service") is operated by BRAINCUP, Blaž Cigale s.p. ("we", "us"). It checks the availability and response time of websites, APIs, ports and servers from several locations, watches certificates, domain expiry and DNS, receives heartbeat pings from scheduled jobs, and alerts you by the channels you choose. What each plan includes is on the pricing page.
The service is meant for businesses and professionals. By using it you confirm you are at least 16 and, if you act for a company, that you may bind it to these terms.
2. Your account
- Give us a working e-mail address. Alerts and important notices go there.
- Keep your sign-in secure. You are responsible for what happens in your account, including actions of team members you invite.
- The organization owner controls the account, its team and its plan.
3. What you may monitor
Monitor only services you own or have permission to monitor. Our probes send ordinary requests at the interval you set; you must not use the service to load-test, scan, attack or overwhelm anyone else's systems, to hide what you are doing, or to break the law. We may limit checks against a target that asks us to stop, and we may suspend accounts that misuse the service (see section 10).
Some features (more frequent checks, more locations) require you to verify that you control a target. We may change or remove unverified monitors that cause complaints.
4. Acceptable use
- No attempts to access other customers' data, our systems beyond your account, or to get around plan limits.
- No reselling the service as your own without a written agreement (the Agency plan lets you serve your clients with it).
- No automated sign-ups or accounts created to abuse free plans.
5. Plans, payment and taxes
Paid plans are subscriptions billed monthly or yearly in advance. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle handles payment, invoices, sales tax/VAT and payment-related customer service, under Paddle's buyer terms.
- Prices are shown on the pricing page. In the EU, UK and Australia they include VAT or GST; in the US and Canada sales tax is added at checkout where it applies.
- Subscriptions renew automatically until you cancel.
- Upgrading takes effect right away and the difference is charged pro rata. Downgrading is possible when your usage fits the lower plan.
- If a payment fails, we keep your plan while Paddle retries. If it keeps failing, the subscription ends and your account moves to the Free plan.
- We may change prices. Changes apply from your next billing period, and we tell you at least 30 days before.
6. Cancellation and refunds
- You can cancel any time from the plan page or the billing portal. You keep the paid plan until the end of the period you paid for; then the account moves to Free. Your monitors keep running as before for another 7 days; after that, monitors over the Free limit are paused (not deleted) and the rest follow the Free plan's interval and locations. Choose a paid plan again and paused monitors start on their own.
- First payment: if the service is not right for you, ask for a full refund within 14 days of your first payment for a plan, no questions asked.
- Renewals and later upgrades are not refunded, except where the law requires it or where the service was substantially unavailable because of us.
- Refunds are paid by Paddle to the original payment method. To ask for one, write to info@pulsekeeper.io or contact Paddle through your receipt.
7. Free plan and beta
The Free plan and any feature marked as beta or "soon" are provided as they are, may change, and may have lower limits. We may end the Free plan with 30 days' notice.
8. Availability and what monitoring can and cannot do
We work hard to keep the service running and to avoid false alarms, but monitoring is best effort: networks fail, alerts can be delayed or lost by e-mail, SMS or chat providers, and a check from our locations may not match what every visitor sees. PulseKeeper is not a replacement for your own safeguards, and we do not guarantee that every outage will be detected or every alert delivered. Unless we sign a separate agreement with you, there is no service level guarantee or service credit.
9. Your data
Your monitors, measurements and settings remain yours. We use them only to provide the service, as described in the Privacy Policy. For personal data of your team and clients that you put in, you are the controller and we process it on your behalf; a data processing agreement is available on request. We delete your data after your account is closed, as the Privacy Policy describes.
10. Suspension and termination
You can stop using the service and ask us to delete your account at any time. We may suspend or close an account that breaks these terms, puts others at risk or does not pay. Where possible we tell you first and give you a chance to fix it. While an account is suspended, checks and alerts are stopped and the reason is shown on your dashboard.
11. Liability
To the extent the law allows, we are not liable for indirect or consequential losses, lost profits, revenue or data, or for losses caused by an outage we did not detect or an alert that did not arrive. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, such as for intent or gross negligence, or your rights as a consumer under mandatory law.
12. Third-party services
Integrations (Google, GitHub, GitLab, Bitbucket, Slack, Discord, Telegram, SMS carriers, your webhooks) are provided by others under their terms. We are not responsible for them, but we choose them carefully.
13. Law and disputes
These terms are governed by the law of Slovenia. Disputes go to the competent court at our registered seat, unless mandatory consumer law gives you the right to sue where you live.
14. Changes to these terms
We may update these terms. When a change matters, we tell account owners by e-mail at least 30 days before it takes effect; if you do not agree, you can cancel before then. The date at the top shows the latest version.
